Terms of service
Yes — same issue here. The existing Terms are generic Shopify boilerplate and contain a lot that does not fit a manual Shopify optimization/service business: physical products, shipping charges, inventory/quantities, product images, resellers, etc. Eingefügtes Markdown It also still contains placeholders and the old CAPE email at the bottom. I would replace the whole thing with this:
Terms of Service
Last updated: October 2026
These Terms of Service (“Terms”) govern your use of chopchopify.com and the purchase of Shopify optimization and other professional services offered by CAPE Consulting & Companies LLC, operating as ChopChopify (“ChopChopify,” “we,” “us,” or “our”).
By using our website or purchasing a service, you agree to these Terms.
1. Our Services
ChopChopify provides professional services for Shopify stores, including Shopify speed optimization, Core Web Vitals optimization, technical improvements, store reviews, consulting, development, and related services.
The exact scope of work depends on the service or package purchased and any additional scope agreed between you and ChopChopify.
Unless expressly stated otherwise, our services are digital, non-physical professional services.
2. Orders & Service Agreements
When you purchase a service through our website, you are requesting the service described on the relevant service or product page.
We may contact you after purchase to obtain information or access necessary to begin the work.
For custom projects, additional work, or projects requiring a separate quotation, the scope, price, and other project-specific conditions may be agreed separately in writing.
We reserve the right to decline or cancel an order where we reasonably cannot provide the requested service. If we cancel a paid order before work has begun, the applicable payment will be refunded.
3. Customer Responsibilities
To perform our services, we may require information or temporary access to your Shopify store, theme, installed apps, analytics, or other relevant systems.
You agree to:
- Provide accurate information about your store and requirements
- Provide the access reasonably necessary to perform the agreed work
- Respond to questions or requests where your input is required
- Maintain appropriate backups and administrative control of your business systems
- Ensure that you are authorized to grant us access to the relevant store, accounts, and systems
Delays in providing information, access, approvals, or feedback may delay completion of the service.
4. Shopify Store Access
Where access to your Shopify store is required, we will use that access only as reasonably necessary to perform the agreed services.
Whenever practical, development and testing may be performed on duplicate themes, development environments, or other non-live versions before changes are applied to your live store.
You remain responsible for your Shopify account, store ownership, passwords, billing arrangements, and relationships with Shopify and third-party applications.
5. Performance & Results
We aim to provide high-quality Shopify optimization services and make improvements based on the condition and technical setup of your store.
However, website performance depends on many factors outside our control, including:
- Shopify's infrastructure
- Your theme and theme updates
- Third-party applications
- Tracking and marketing scripts
- Customer devices and network conditions
- External services
- Content and media added to the store
- Changes made after our work has been completed
For this reason, specific performance scores, Core Web Vitals results, conversion improvements, revenue increases, search rankings, or other commercial outcomes are not guaranteed unless expressly agreed in writing.
Any examples, case studies, performance results, or customer outcomes shown on our website illustrate previous results and do not guarantee identical results for another store.
6. Third-Party Apps & Services
Shopify stores commonly rely on third-party themes, applications, scripts, integrations, and external services.
We are not responsible for failures, changes, incompatibilities, outages, pricing changes, or other actions caused by Shopify or third-party providers.
Where our work involves a third-party product or service, its own terms and conditions may also apply.
7. Prices & Payment
Prices displayed on our website may be changed at any time.
The price applicable to your order is the price shown and accepted at the time of purchase unless otherwise agreed in writing.
Payments made through our website are processed using Shopify and supported payment providers.
For custom work or additional services, payment terms may be specified separately in the relevant quotation or agreement.
8. Additional Work & Changes in Scope
A purchased package covers the scope described for that service.
Requests that materially exceed the original scope may require additional work and additional charges. Where appropriate, we will discuss this with you before proceeding.
Changes requested after work has begun may also affect the expected completion time.
9. Refunds & Cancellations
Our Shopify optimization packages and other professional services are digital, non-physical services. Once work has started, the service cannot be returned and is generally not eligible for a refund.
If you are not satisfied with the work or believe something has not been delivered as agreed, please contact us. We will review the situation with you and work toward a fair solution.
If you wish to cancel a project before work has started, please contact us as soon as possible so we can review the status of your order.
Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.
For questions regarding a service, cancellation, or refund, contact jamie@chopchopify.com.
10. Intellectual Property
Unless otherwise agreed, ChopChopify retains ownership of its pre-existing tools, methods, processes, know-how, templates, systems, and other intellectual property used in providing the services.
Once the applicable service has been paid for in full, you may use store-specific work and modifications delivered specifically for your Shopify store as part of operating that store.
You may not copy, resell, distribute, or commercially exploit ChopChopify's proprietary materials, processes, or website content without our permission.
11. Website Content
The information provided on our website is intended to explain our services and provide general information about Shopify performance and related topics.
We make reasonable efforts to keep this information accurate, but we do not guarantee that every piece of website content will always be complete, current, or error-free.
We may update or modify website content, services, packages, and pricing at any time.
12. Prohibited Use

- For unlawful or fraudulent purposes
- To violate the rights of another person or business
- To transmit malicious code or interfere with website security
- To attempt unauthorized access to systems or data
- To copy or exploit our website, services, or proprietary materials without authorization
- To provide false or misleading information in connection with an order or service
We may refuse or discontinue service where there is reasonable evidence of unlawful, abusive, fraudulent, or otherwise inappropriate use.
13. Limitation of Liability
To the maximum extent permitted by applicable law, ChopChopify and CAPE Consulting & Companies LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, business opportunities, or anticipated savings arising from the use of our website or services.
To the maximum extent permitted by applicable law, our total liability relating to a particular purchased service will not exceed the amount you paid us for that service.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
14. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
By using our website and services, you acknowledge that personal information may be processed as described in that policy.
15. Termination
We may suspend or terminate access to our services where you materially breach these Terms, fail to make an agreed payment, misuse our services, or engage in unlawful or abusive conduct.
